BREAKING: Appeals Court Sets Aside Decision Upholding PPACA On Anti-Injunction Act Grounds

In a separate opinion from the simultaneously released Commonwealth of Virginia v. Sebelius, The Fourth Circuit Court of Appeals has set aside a federal court ruling that upheld the individual mandate of the Patient Protection and Affordable Care Act (P.L. 111-148)  on the ground that the lawsuit was premature. The court ruled that the lawsuit challenged a tax, and that the Anti-Injunction Act bans court actions to prevent assessment or collection of any tax. More to come.
