National Coverage Determinations & Consent to Treatment: An Enterprise Risk
FEATURED SPEAKER
Fay Rozovsky, President
The Rozovsky Group
SUMMARY
Operating on the wrong patient, the wrong site, or conducting the wrong procedure involves more than the risk of a professional liability claim. In the world of National Coverage Determinations, or “NCDs,” such practices carry a heavy financial impact and more.
This presentation examines the enterprise risk management (ERM) exposures stemming from the “three wrongs” NCDs. The featured speaker discusses the importance of consent to treatment as a key ERM tool, along with other strategies to mitigate liability and exposure to compliance risks.
Objectives:
- To describe the “three wrongs” and the role of consent to treatment in the National Coverage Determinations from CMS
- To discuss the liability, compliance, and financial impacts of the National Coverage Determinations
- To examine practical enterprise risk management strategies to mitigate the potential losses involved in the “three wrongs” National Coverage Determinations.
- To illustrate how ego, misguided altruism, and loophole exploitation cause C-Suite executives and clinicians to make decisions resulting in criminal prosecutions and jail time.
